Condominiums Created Within a Portion of a Building

Clarifies that a condominium association created within a portion of a building under §718.407, F.S., may inspect and copy the books and records upon which the costs for maintaining and operating any shared facilities are based, and must receive an annual budget with respect to such costs.

 

Requires that, within 60 days after the end of each fiscal year, a complete financial report of all costs for maintaining and operating the shared facilities must be provided to the association. This report must include copies of all receipts and invoices.

 

Allows the association to challenge any apportionment of costs for the maintenance and operation of the shared facilities, provided that the challenge is made within 60 days after receipt of the financial report. A challenge under this provision will be governed by homeowners’ associations' dispute provisions.

 

Authorizes the Division to impose penalties and enforce compliance if an owner fails to provide a financial report on the costs of operating and maintaining shared facilities, including copies of the receipts and invoices, within 60 days of the end of the fiscal year.

 

Effective date: July 1, 2025, unless otherwise provided in the bill.
